Gate Management Operations

Controlled Access Personnel:

The Board of Directors of the La Paloma Property Owner's Association, Inc. (LPPOA) wish to acknowledge receipt of an email during the early morning hours of December 17 and which was dated December 2, 2018 and signed by eight Controlled Access Personnel (CAP) gate attendants. Through this memo, the Board wishes to address the concerns raised.

The concerns expressed in the email have been passed along to HBS Management Solutions (HBS). Howard Schmitter, the owner of HBS, has indicated to us that he is more than willing to sit down individually in a one-on-one environment to discuss any concerns that you may have. If you wish to express your concerns, please call Howard Schmitter at 520-664-5754 to set up an appointment for such a meeting.

It should be noted that each current LPPOA employee will be paid their accrued vacation and sick time as of December 31, 2018, with the final paycheck that they will receive from the LPPOA. Furthermore, HBS has indicated to us that should any one want or need to take vacation between January 1 and April 1 that they will work with them to accommodate their needs. Any vacation time taken during that period would be unpaid but since all CAP will have received payment from the LPPOA on December 31 for the vacation time that they have accrued through the end of December it is not as if such employee will not have received pay for any vacation time that they may take during the first three months of 2019. Therefore, it is not true that anyone will lose any accrued vacation they may have earned but not taken while they were an employee of the LPPOA. Additionally, as of April 1 each employee who works for HBS will have banked some vacation time with HBS. As a result of this action by the LPPOA Board, there is no basis for the expressed concern regarding not being paid for the vacation time an employee may have earned up through the end of 2018.

As of January 1, 2019, those of you who have accepted contracts offered to you by HBS will become employees of HBS and the LPPOA will no longer have any direct employment relationship with you. The La Paloma Employee Policy Manual will become irrelevant as it was designed to cover employees of the LPPOA. Thus your understanding that the La Paloma Employee manual will be completely eliminated as of January 1, 2019 is correct. As of January 1, 2019, all CAP working the La Paloma gates will be covered by the employment policies established by HBS and any employee manual that they may utilize.

HBS will be responsible for implementing LPPOA policies related to the operation of the gates and access to the La Paloma communities. In doing so, HBS will receive input from the LPPOA in making any changes to existing gate procedures. Gate procedures are a completely different issue than employee policies for which HBS will be totally responsible. Their employee policies will likely be the same for all of their employees regardless of which location they work at but the policies and procedures for operating the gates is likely to be somewhat different at each location served by HBS employees.

HBS has decided to bring in its own supervisor who is already trained in their methods of operation. This is their decision to make not ours. We anticipate that there will be a smooth transition as you adjust to a new supervisor.
